Additionally, failing a post-arrest chemical test could result in the confiscation of your CDL. At this point, you will be given a temporary license that is valid for up to 41 days. At this point, you will need to request a Texas DPS hearing to disprove your charges. If you lose the DPS hearing, your CDL will be suspended for one year.
