DUIs and CDLs

Many Texas citizens rely on a commercial driver's license (CDL) to earn a living and support their families. These drivers could be operating large vehicles that transport cargo or passengers. If you find yourself convicted of a DUI, you are at risk of losing your CDL, making it challenging to support yourself and your family. Along with losing your CDL, you could face additional penalties after being charged with a DUI.

DUI's and CDL Consequences:

The legal limit for the average motorist is a blood alcohol content (BAC) of .08 percent; however, if you are a commercial driver, you could be charged with a DUI with a BAC of .04 percent. At Denuna Law Firm we do our best to help when you face life-altering penalties. If this is your first DUI in Texas, you could face a Class B misdemeanor, which consists of the following consequences: minimum confinement of 72 hours, a jail sentence up to 180 days, a maximum $2,000 fine, and the suspension of your CDL for up to one year. Furthermore, if you are transferring hazardous material at the time of your arrest, you could lose your CDL for up to three years, making it difficult to find alternate work. If you are arrested more than once for a DUI, you could potentially lose your CDL for life.

Additionally, failing a post-arrest chemical test could result in the confiscation of your CDL. At this point, you will be given a temporary license that is valid for up to 41 days. At this point, you will need to request a Texas DPS hearing to disprove your charges. If you lose the DPS hearing, your CDL will be suspended for one year.
